Among the repertories of the Criminal Court of the Cairo Consulate are:

  • registers of criminal judgments from 1861 to 1930;
  • and registers of criminal case files from 1912 to 1937.

The latter are compiled in accordance with Article 251 of the 1866 Consular Regulations, which provides that “every criminal proceeding” conducted by the consul be recorded in a dedicated register, stating:

  • name, surname and residence of the accused;
  • name, surname and residence of the injured party;
  • nature of the offence under investigation;
  • measures issued during the investigation or definitively.

Today these registers, together with the indexes that accompanied them and enabled offices to navigate the very large number of cases, constitute a true archival inventory.

Criminal jurisdiction, exercised by the consul and the consular courts, continued until 1937, when the regime of the capitulations was abolished.

The criminal files, arranged chronologically, are therefore very numerous and constitute, together with civil matters, the core of the Cairo consular archive.

The volumes record the service of documents.

The following columns are present:

  • number;
  • date of the act;
  • nature/subject of the act;
  • to whom and at whose request it is served;
  • date of service;
  • acknowledgement of service.

Registration constitutes the receipt for the act. Under Article 229 of the 1866 Consular Regulations, for a receipt to be valid it must contain:

  • what act was received;
  • the name of the person by whom the act is delivered or served;
  • the year, day, month and hour of delivery or service;
  • and the capacity of the person signing the receipt (whether the defendant themself or a relative/household member).

The appointment of assessor judges is governed by Article 69 of the Consular Law of 1866.

At the beginning of each year, the consul selects, from among persons resident in the consular district—preferably Italians—the number of judges and substitute judges deemed necessary for the proper administration of justice.

The scope of criminal jurisdiction is determined by articles 112, 113 and 114 of the Consular Law of 1866, which provide that:

  • the consul acts as judge of misdemeanours committed by Italians within the consular district or on board merchant vessels flying the national flag (art. 112);
  • consular courts act as judges of offences committed by Italians within the consular district or on board merchant vessels flying the national flag (art. 113);
  • and the Assise Courts of Ancona and Genoa (Ancona for Egypt) have jurisdiction over the trial of crimes (art. 114).

Article 230 of the 1866 Consular Regulations provides that every application submitted to the consul giving rise to proceedings be recorded in a special register by the chancellery officer.

This column-based register must contain:

  • name, surname and residence of the applicant;
    • name, surname and residence of the opposing party;
    • subject or nature of the application or act;
    • date of submission;
    • supporting documents;
    • measures issued by the consul;
    • date and method of notification;
    • subsequent measures.

For civil proceedings, only one index/register has so far been located.
