Description
Notarial functions are generally entrusted to consuls, in accordance with consular law, which recognises their status as public notaries.
The principle is laid down in Article 20 of the Consular Law, which provides that “consuls also hold the capacity of notaries”.
In general terms, the consul has jurisdiction to receive:
deeds in which one or more parties are foreign and which must be recognised in Italy in order to be enforced;
and deeds concerning property located in the country of the consul’s residence.
The consul authenticates commercial books; authenticates private deeds; draws up protests for non-payment; and receives wills.
Deeds drawn up in the consular chancellery must be written in the Italian language.
